General conditions
The general conditions settle the agreement between Arjeplog Municipality, Org.Reg.No. 212000-2668 named ’A-net’ and natural or legal persons that subscribe one or several A-net services for companies named ’subscriber’. The agreement entitles the subscriber to use the services agreed upon and supplied by the A-net. The service will be connected after the agreement has been signed and the connection of the A-net has been completed to the customer in question.

Description of service
A-net is the local network of the Arjeplog Municipality. Internet will be connected to this. There can be no liability in this agreement for any technical problems caused by the Internetsupplier. The band width to Internet is 0.5 Mb/s unspecified capacity. Due to the nature of Internet no transmission capacity to specific home pages can be guaranteed. In the agreement e-mailboxes are included to which 5 alias can be connected. E-mail can also be read via Webmail. The subscriber is liable for continually clearing his e- mailboxes. If this is not complied with, A-net is entitled to stop incoming e-mail. 25 MB space in all to be used for a home page of one’s own and Webmail is included in the agreement. A-net is not liable for any loss of data on the server such as may arise, no back up will be made on the home page of the subscriber or of any other data belonging to the subscriber. A-net will not provide any support as regards creating home pages of one’s own. The connection is a permanent connection with an assigned public IP-address.

Equipment and connection
A-net remains the owner of all the equipment up to the point of delivery. The customer is liable for the equipment and maintains the equipment so that no damage is caused by negligence. The subscriber is to use such equipment that meets the standards provided by current legislation. In case of disturbance that may occur the subscriber is obliged to disconnect the disturbing equipment immediately. The point of delivery is in the ODF (a pair of optical fibres with SC/APC contact. The customer provides himself with the equipment for his own network.

Security and computer infringement
The subscriber alone is liable for the security of his network as regards computer infringement.

Customer support
Faultreport can be made day and night to 0911-23 23 32 or felanmalan@arjeplog.com. A-net is liable for the network up to the point of delivery. Removal of technical problems in the computer equipment of the subscriber like the operating system, other kinds of software or network card is not included. Questions regarding invoices: dial 0961-14 000 telephone operator.

Availability and interruption etc.
Regards the equipment of A-net. The removal of technical problems is to start within four hours in case of urgent major technical problems. In other cases the removal of technical problems is to start the day after at the latest within regular working hours, Monday-Friday 07.00-16.00

Maintenance etc
Information on scheduled maintenance is given on www.arjeplog.com. When extensive measures are required the subscriber is to be informed early enough before the interruption.

Personal details
By giving the personal details required in the agreement the subscriber gives his consent to the Arjeplog Municipality to use the information in order to create a file containing records for the connection, to provide services and for administration. There may be multiprogramming ( with other files) in order to update names and addresses.

Limited liability
A-net shall not be liable for any damage, any consequential damage or any indirect damage or any loss that may be caused by an interruption of the connection. A-Net shall not be liable for the information that the subscriber provides himself by the service. A-Net shall be liable for neither the contents of the personal home page of the subscriber, nor the information in the e-mail of the subscriber nor the activities of the subscriber on Internet.

Period of the agreement
The agreement shall be valid from the time it was made and shall be valid until further notice. There shall be three months’ notice. A-Net shall have no obligation to repay the connection fee or any other once-for-all charges when the agreement expires. The notice is to be handed in to the following address in writing: A-Net, Tingsbacka, 930 90 Arjeplog.

Compensation and payment
A fixed periodical fee will be charged for the service. The fee is to be paid quarterly after delivery. If possible, invoicing is to be done by a collective invoice for municipal fees. Terms of payment 30 days net. After the due date interest on arrears will be charged in conformity with the Interest Act as well as a reminder fee regulated by law and if applicable a debt collection fee. If payment has not been made after the reminder, A-Net is entitled to disconnect until full payment has been made.

Transfer and removal
The subscriber must not transfer the agreement without the consent of A-Net. A-Net is entitled to transfer the agreement to another supplier without the consent of the customer. In case of a change of owners or removal the customer is to inform A-Net about the coming changes.

Improper use of the network
The subscriber undertakes to comply with the ethical code that applies to the service. The current netiquette can be found on the home page of A-Net www.arjeplog.com. Violation of the netiquette can result in immediate disconnection of the service.

Reselling
The customer is not entitled to resell the connection as regards the service agreed upon without the consent of A-Net. The consent must be in writing.

Additional orders
Additional service will be subscribed with a separate fee and conditions for the service in question.

Disconnection, termination in advance, right to reverse a purchase etc.
A-Net is entitled to terminate this agreement with immediate effect and disconnect the service of the customer without any obligation to repay the customer, if it turns out that the customer has used the service in an improper way. Some examples follow below: 1 Distribution of illegal information. 2 Usage of the service in order to commit an illegal action. 3 The customer has not paid the invoice within the time prescribed.

Alteration
The subscriber agrees with and accepts that the service of A-Net can be altered as regards the scope of the service and its contents, but not as regards its fundamental, functional properties. If possible, A-Net is to inform the subscriber on the alterations that will considerably affect the service agreed upon. A-net is to do this with at least 30 days’ notice. If the alteration mentioned above implies a considerable disadvantage to the subscriber, he is entitled to terminate the agreement in writing during the period of agreement with effect from the time the alteration was executed.

Information
A-Net gives continuous information on the service via its home page www.arjeplog.com. On the home page information on interruption of the service is also given.

Force majeure
Either party shall have exemption from paying damages and shall be free from other sanctions if the execution of a certain obligation is prevented or is considerably impeded by circumstances that reasonably are beyond the control of either party or that either party could not reasonably have foreseen. Among others the following circumstances shall grant exemption: industrial dispute, a stroke of lightning, fire, directions done by authorities or other public regulations, technical problems in the network of another network operator, general shortage of transports, goods or energy or any other similar circumstance. If the fulfilment of the agreement is prevented to an considerable extent during a longer period of time than three months due to the circumstances mentioned above, either party is entitled to terminate the agreement in writing with immediate effect.

Applicable laws and dispute
In case of a dispute between A-Net and the subscriber, A-Net and the subscriber are primarily to try to effect the dispute by a settlement. If the parties cannot agree, the dispute is to be settled by ordinary court.
